Terms of Service.

1. Acceptance of Terms

By accessing hamo.tn, contracting Hamo Studio for custom software engineering, or utilizing our managed hosting and domain services, you agree to comply with and be legally bound by these Terms of Service and our Privacy Policy.

2. Scope of Services

Hamo Studio provides digital agency services, including but not limited to:

• Custom web application development, mobile engineering (React Native/Expo), and API architecture.
• Managed VPS, containerized Docker deployments, and cloud infrastructure operations.
• Domain name registration, DNS management, and SSL certificate provisioning.
• Post-launch maintenance, database backups, and system security updates.

3. User Accounts & Security

When creating an account on Hamo Studio portals or authorization services (e.g., Hamo ID), you are responsible for maintaining the confidentiality of your credentials and SSH keys. You agree to immediately notify us of any unauthorized access to your account or infrastructure.

4. Acceptable Use Policy

You agree not to use our infrastructure, hosting, or applications for any illegal or unauthorized activities, including:

• Hosting, distributing, or transmitting malware, ransomware, or malicious code.
• Executing unauthorized vulnerability scans, DDoS attacks, or network abuse.
• Sending unsolicited bulk emails (SPAM) or violating email deliverability regulations.
• Hosting or distributing content that infringes upon third-party intellectual property rights.

5. Payments, Renewals & Billing

Fees for custom development, managed hosting, and domain renewals are billed according to project proposals or recurring subscription cycles. Failure to settle invoices by the due date may result in temporary suspension or termination of hosted services and domain delegation.

6. Intellectual Property Rights

Upon full payment of contractual fees, all custom code, assets, and deliverables created specifically for client projects are assigned to the client. Hamo Studio retains ownership of proprietary developer tools, reusable boilerplate frameworks, and agency branding elements.

7. Service Availability & SLA

While we strive for 99.9% uptime on managed cloud infrastructure, services are provided on an "as is" and "as available" basis. Scheduled maintenance windows are communicated in advance. Hamo Studio is not liable for service interruptions caused by third-party upstream providers, force majeure, or client configuration errors.

8. Limitation of Liability

To the maximum extent permitted by law, Hamo Studio shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or business interruption, arising out of or in connection with the use of our services.

9. Termination

We reserve the right to suspend or terminate your access to our services or hosting infrastructure immediately, without prior notice, in the event of a material breach of these Terms, non-payment, or illegal activities.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Tunisia. Any legal disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts in Tunisia.
